Litton Industries, Inc.

Litton had been in litigation in state court against Microwave Holdings, Inc. and its principal for more than three years. On the eve of trial, MHI filed a Chapter 11 petition in Bakersfield and removed the state court lawsuit to the bankruptcy court. Acting quickly, SulmeyerKupetz brought motions for remand and abstention and for relief from the automatic stay, thus allowing the trial to proceed in state court. After the trial, SulmeyerKupetz obtained monetary sanctions of approximately $30,000 against MHI, its law firms, the individual attorneys, and the debtor’s president and chairman of the board who signed the debtor’s Chapter 11 petition.
